FOSSとは、Free(/Libre) and Open Source Softwareの頭字語であり、自由ソフトウェアとオープンソースをまとめて表現する語である。[1][2][3][4][5][6][7]FLOSSとも呼ばれ、GNUプロジェクトからはFLOSSの表現が好まれている。[7]
FLOSSという概念において留意すべきなのは、日本語では一般に「自由」と括られているLibre（Liberty、リバティ）とFree（フリー）には以下のような意味の違いがあるということである。すなわち「フリーは古英語の frēo に由来し、束縛や拘束がなく義務を免除された状態、すなわち自由の消極的側面 （しなくてよい）が強調される。一方リバティはラテン語の libertas が語源であり、選択や行動・発言の権利が保障された状態、つまり積極的側面（してよろしい）に比重が置かれる[8]」。例えば、アメリカ合衆国によるイギリスからの独立100周年を祝いフランスから贈呈された、アメリカのニューヨークにある自由の女神像がStatue of Liberty（Statue of Freedomではない）と呼ばれている理由はここにある。すなわち、重点は他者の干渉を受けないという消極的自由（liberty from the authority/cost of a software、GNUによるフリーソフトウェアの定義ではFree Beerと表現されている）ではなく、自己の意思を実現しうるという意味における積極的自由にある（つまりliberty to the software）とみることが出来る。
